This Datagrid Acceptable Use Policy (“AUP”) establishes the principles, responsibilities, and restrictions governing Customer’s and its Authorized Users’ use of the Subscription Services.
Capitalized terms not otherwise defined below will have the meanings in the Agreement.
1. Compliance with Laws
Customer and its Authorized Users will comply with all applicable laws, rules, and regulations in using the Subscription Services, including but not limited to, all applicable export control laws and regulations, and all applicable industry standards, building codes, and employment laws.
2. Content and Conduct Restrictions
Customer and its Authorized Users will not, and will not allow or encourage any third party to, upload, publish, distribute, create, collect, or transmit any content through the Subscription Services, that is, does, or may:
- be unlawful, tortious, promoting unlawful activities, or soliciting conduct that is illegal under applicable law;
- be fraudulent, false, misleading, or intentionally deceptive, including the misrepresentation of any AI-generated Output as solely human-generated, or the removal, alteration, or obscuring of metadata, digital signatures, or watermarks that identify Output as AI-generated;
- Use Output to create, train, or improve other AI systems or models;
- be defamatory, libelous, indecent, obscene, pornographic, vulgar, or otherwise offensive, or that relates to sexual exploitation, violence, or abuse, including of minors;
- promote or incite discrimination, bigotry, racism, hatred, harassment, bullying, or harm against any individual or group, including on the basis of a protected characteristic;
- be threatening, inciteful, or glorifying violence against any person or entity, including terrorism, gratuitously violent imagery, self-harm, and weapons development or procurement;
- be harassing, intimidating, degrading, hateful or abusive towards any individual or group;
- be harmful to minors, in any manner;
- include Personal Data of children under 13 or any age of digital consent under applicable law;
- constitute false, inaccurate, or intentionally deceptive information that is likely to adversely affect the public interest, including health, safety, election integrity, or civic participation;
- be malicious or destructive, including viruses, worms, trojan horses, spyware, scareware, crimeware, or any other harmful code or programs;
- violate the rights of any third party, including intellectual property rights, privacy rights, or confidentiality obligations, or that incorporates third-party content without authorization;
- consist of or include sensitive personal data subject to regulation or protection under applicable law;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- involve the use of facial recognition or any biometric information;
- constitute unsolicited or unauthorized communications, including spam;
- cause or is intended to cause bias, discrimination, or harm against any individual, or that is used to make automated decisions about individuals where such decisions could have a legal or similarly significant effect;
- evaluate or classify individuals based on personal traits or information, social behavior or biometric data (including any social scoring), or make any inferences about an individual’s emotions;
- involve the use of the Subscription Services for activities in which the use or failure of the Subscription Services could lead to death, bodily injury, damage to personal property, or environmental damage;
- automate high-stakes decisions in sensitive areas, such as critical infrastructure, employment, housing, or essential government services;
- be intended to circumvent applicable international sanctions with respect to any individual or organization; or
- involve a national or state secret, classified information, controlled unclassified information, export controlled information, or any other information or material (including photos, drawings, specifications, models, or other construction documents) that is subject to official confidentiality treatment.
Additionally, Customer and its Authorized Users will not, and will not allow or encourage any third party, to do any of the following:
- damage, bypass, disable, override, interfere with, or circumvent any aspect of the Subscription Services, including any safety, integrity, privacy, or security filters, instructions, controls, safeguards, or other protective mechanisms;
- interfere with or disrupt the operation of the Subscription Services or any other user’s use of the Subscription Services, including by exceeding or attempting to exceed applicable load or capacity specifications or by generating synthetic data;
- test, probe, scan, or penetrate the Subscription Services for security vulnerabilities or limitations, except in compliance with Datagrid’s authorized bug bounty program;
- use the Subscription Services to compete with Datagrid, or reverse-engineer, copy, or replicate any ideas, features, functions, or graphics of the Subscription Services;
- Attempt to reconstruct or infer training data in any AI Service;
- scrape, data mine, or access the Subscription Services or any content made available through the Subscription Services by automated or programmatic means, except as expressly permitted in writing by Datagrid;
- access or use the Subscription Services in a manner intended to avoid incurring applicable fees, including by sharing account credentials, rotating seat assignments among users, or any other means of circumventing seat-based or usage-based pricing;
- use the Subscription Services in any emergency scenario, for purposes of seeking any legal, medical, or tax advice, or otherwise for any purposes other than the express purposes authorized by the Agreement;
- modify, or use any tool or method to modify, Datagrid’s code or code execution; or
- act in bad faith in connection with your use of the Subscription Services.
3. Enforcement
Datagrid may reasonably suspend or disable access to the Subscription Services and AI Services as it deems necessary, in whole or in part, to address a potential or actual violation of this AUP or to protect the security, integrity, or lawful operation of the Subscription Services. Datagrid reserves the right to investigate suspected violations and to take appropriate action, which may include suspension or termination of access to the Subscription Services, or the platform.
4. Changes to the AUP
Datagrid may update this AUP from time to time by posting a revised version on the Datagrid website or within the platform. Updates will be effective upon posting.
